It is important to understand the different standards that are applied by the Courts in making decisions that result in Adoption proceedings. If you are a parent of a child that has been adjudicated as dependent, and the Court is deciding whether the goal should be changed to adoption, then the Court must review a list of statutory factors set forth in the Juvenile Code. However, if a Petition to Terminate Parental Rights has been filed in the Orphans' Court, then the Court must review whether a termination of parental rights should be granted based on the statutory grounds for termination. Whether one should consent to an Adoption or contest a Petition to Terminate Parental Rights can be an extremely difficult, and should only be made after proper consultation with counsel.
